Conditions of hire for rental

  1. Definitions

    Apartment   is bungalow 3501 of Imperial Park, Calpe, Spain
    Rental Amount is the rental that you have been quoted

  2. Booking Request
    A booking request can be made by telephone, email or from the website.  All Booking requests are subject to these conditions which are deemed to have been accepted in full by the Hirer and all persons in the party upon acceptance of the booking request. 
  3. Confirmation
    Your Booking request is only confirmed upon receipt of, and successful encashment of your deposit and receipt of a signed set of conditions.  Confirmation will be sent by e-mail to you stating the balance due date, guarantees
    and any other pertinent information.  This then forms a binding contract.
  4. Booking 
    A booking only is deemed to be fully accepted ONLY when the deposit and balance, or full payment, and guarantees are made successfully, the conditions document is signed and returned and the information form is completed and sent.  No cheques should be post-dated.
  5. Payment
    1. If your Booking is made more than ten weeks before the Hire date of your Booking it must be accompanied by a deposit of 20%, or a minimum of £150, of the total price.  The payment should be accompanied by a signed copy of the conditions document and the website information form should be submitted through the web at the same time.  
    2. If your Booking is made ten weeks or less before the Hire date full payment must be made accompanied by a signed copy of the conditions document and the website information form should be submitted through the web at the same time. 
  6. Balance
    In the case of payment under 5.1, the balance amount, which is the difference between the Total Price and the Deposit amount, must be paid without notification a clear ten weeks prior to the Hire date.  Payment of the Deposit amount and Balance amount constitute Full Payment 

    If I do not receive the balance by the ninth week prior to your rental i, at my discretion, shall either:
    1. If paid by credit card, I shall automatically charge your credit card the balance amount (see Credit/Debit Card Guarantee)
    2. If paid by means other than credit card then i shall similarly claim and you shall also incur and additional £25 handling fee.  
    3. Cancel the booking without prejudice to a claim for cancellation charges and claim any amounts already paid
  7. Guarantee
    A guarantee should be provided ten weeks before the Hire date of your Booking.  If your Booking is greater then ten weeks before the Hire date of your Booking it must be provided at the same time as full-payment else it should accompany the balance payment.  It should be made without notificationThe guarantee is the greater of £150 or 10%.  The guarantee should be made by separate cheque and not be post-dated
  8. Optional payments
    Payments and guarantees for optional items suggested by the Leasor shall be be made when Full payment or Balance payment (as applicable) is made.  
  9. Amendment charges
    In the event you wish to alter details of a Confirmed booking, if accepted by the Leasor, there may be an amendment charge of £25 at the leasers discretion in addition to the increase, if any, in the cost of the revised arrangements. If the new amount is less then the default scenario will be that NO refund is due unless the Leasor agrees otherwise.  All amendments must be sent by eMail and are only deemed effective once confirmed.
  10. Cancellation by Hirer  
    All cancellations of Bookings must be in writing or email  and notified to and received by no later than ten clear weeks prior to rental period. The following charges shall then apply:
    1. If cancellation is prior to the 10 week deadline the Deposit only will be forfeited
    2. If cancellation is less than ten but greater than four clear weeks before departure 50% of Full Payment is forfeited
    3. If cancelled four weeks or less prior to arrival date, then 100% of Full Payment is forfeited

    I will assist the Hirer, when required, with the necessary insurance cover letter in the event of cancellation.  If it is possible to fill the Apartment  during this ten week period and after cancellation then only the 20% deposit will be lost.

  11. What is included
    The rental includes: The cost of water, electricity, gas, and use of communal facilities provided by the hotel part of the complex, a full inventory of equipment and utensils, and a weekly change of linen and towels. With respect to linen/towels the following is relevant:

    bulletFor 1-4 week lets you will receive clean bedding/linen each week but on the mid week weekly changeovers you need to put all dirty bedding/towels through the washing machine yourself, dry where possible and then leave in a bag or on the side for the cleaner who will take it to iron.  Note: From experience this has proved to be the best way of handling this issue since it results in minimal disturbance to the hirer.
    bulletFor long lets (>4 weeks) you will receive clean bedding when you move in but thereafter the washing/ironing/changes are the responsibility of the renter
  13. What is not included
    The Apartment  rental prices does not include any telephone calls, additional/option payments for hotel services, option payments for the bungalow, personal insurance, travel, transportation or airport to Apartment  transport
  14. Occupancy
    Only persons listed on the Information form may occupy the Apartment . The Hirer cannot be re-let/sublet to any other group/party without the written approval of the owners.  Pets are not allowed. Smoking is not allowed.  Under no circumstances may more than the maximum number of persons specified in the Apartment  description, or booking form, occupy the Apartment  except by prior written agreement. The right is reserved to refuse admittance to the Apartment  to the hirer and their party if they are in breach of this condition
  15. Arrival and Departure 
    The Apartment  will be available for occupation from 17.00 hrs on the day of arrival and must be vacated by 10.00 hrs on the day of departure. Entry before this time is not permitted as cleaning will take place at 10am.  Booking periods run on an individual basis but are generally Friday-Friday. Variations to this are for long lets and would be confirmed in writing.  Departures after 10am, unless agreed in writing in advance, will, at the Leasors discretion, incur an additional fee for the day at the daily rate offered for the apartment
  16. Keys  
    Detailed instructions for key collection and directions to the Apartment  will be sent immediately after receipt of the final payment..
  17. Hirer's Responsibilities
    The hirer is responsible for taking all reasonable care of the property, its contents and their own (partys) behavior.   The Hirer undertakes that they and their party will not endanger the policy of the Apartment owner's insurers in respect of the Apartment  and its contents which might make the same void or voidable. 
    No items must be removed from the Apartment  during your stay. Towels nor any other items may be taken to the beach.  The hirer is responsible for always ensuring that the security features of the apartment (window/door lock/bolts/shutters) are continuously in place when the apartment is unoccupied.
  18. Unacceptable Behavior
    The hirer shall ensure that no member of the party engages in any activity in or around the Apartment , swimming pool or communal areas which may cause offence to neighbours or pollution to the water or damage to the structure or filtration equipment - this includes unacceptable antisocial behavior.  The Hirer agrees that the complex Security and other staff may evict, by force if necessary, the Hirer or member of the party should it be deemed by them that the behaviors is detrimental to the complex and would not be the actions of reasonable people.  The Hirer, nor members of the party, shall have any recourse to claim against the complex, its staff or the Leasor and forfeit any deposits, Balances, Guarantees or other payments made and shall be solely responsible for finding and funding any new accommodation.
  19. Damage to Apartment
    The property and all equipment, utensils, furniture etc. must be left clean and tidy at the end of the hire period. The Hirer will be responsible for making good any damage to the Apartment , or its contents, which has occurred due to negligence, willful damage, accidental damage or irresponsible behavior on the part of those occupying the Apartment, or their guests. This include damages by third parties due to the neglect of the hirer to use the security features of the apartment (window/door lock/bolts/shutters) when the apartment is un occupied.  Such damage must be reported, without delay, to the weekly cleaner or to the Leasor. The cost of most repairs or replacement is identified in the booking information and should be paid for by leaving that sum in the apartment. A figure of £150/10% is held against damage to the property, furnishings or for excessive cleaning requirements. However, the Leasor reserves the right to charge you or your Credit card without further consultation for any excess of this figure for damages sustained.  For those without a Credit card guarantee the Hirer shall seek full compensation and use the Courts where necessary
  20. Rights of Access  
    The Leasors, their representatives, Imperial park hotel staff or subcontractors have the right of access to the property at any time with due regard to the convenience of the hirer for the purpose of inspection of the property and to carry out any essential repair or maintenance work.  In emergency conditions the Hirer agrees to access without consultation
  21. Circumstances Beyond Control 
    The Leasor, nor the Leasors representatives can be held responsible for any circumstances beyond their control including, but not limited to, mechanical breakdown of equipment, illness. weather conditions or failure of any hotel/public service supply. 
  22. Injury and Damage 
    The Leasor does not have any responsibility to compensate you for any personal injury, death, loss or damage of whatever nature suffered by you (or any member of your party) during the booking period.
  23. Information  
    All information supplied is given in good faith and is based upon information available at the time. All reasonable measures have been taken to ensure the accuracy of any statement made, but the Leasor is not liable for any variation however caused.
  24. Complaints  
    In the unlikely event that you have a complaint about the Apartment  or its contents, whilst on holiday, it must be reported immediately to the Hirers local representatives who will take all reasonable steps to resolve the matter and if this is not resolved then the Hirer.  The Hirer nor their representatives shall have any liability for any complaint submitted after the completion of the hire period. The Hirer is not liable, nor can handle Complaints, for any attributes related to the complex itself.  Similarly do not try to involve the complex in a matter which relates to the apartment since it is privately owned and the complex as now responsibility for it.
  25. Force Majeure
    The Hirer regrets they cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by 'force majeure'. In these Conditions of Hire 'force majeure' means any event which the Hirer or the supplier of the service(s) in question could not, even with due care, foresee or avoid. Such events may include, but are not limited to, war, threat of war, civil commotion or strife, hostilities, strikes or other industrial disputes, natural disasters, fire, acts of God, terrorist activities, technical problems, with transportation, closures of ports and ferries, quarantine, epidemics, weather conditions, government action or other events outside our control
  26. Alterations & Cancellations by the Hirer
    In the unlikely event that the Apartment  becomes unavailable, due to circumstances beyond the hirers control,  where possible an alternative accommodation will be found.  If this is not found then a full refund will be given although any refund is restricted to Apartment booking cost.  The Hirer is not liable for any cancellation charges for travel arrangements etc. and the Leasor is advised to take out all the necessary insurances
  27. Extra charges  
    Where there are extra charges based upon usage these will be advised in advance
  28. Insurance The Apartment  hire does not include any personal insurance cover of any kind. IT IS A CONDITION OF BOOKING THAT INSURANCE IS TAKEN OUT AGAINST CANCELLATION AND IT IS STRONGLY RECOMMENDED THAT PERSONAL ACCIDENT AND MEDICAL INSURANCE IS ALSO TAKEN OUT
  29. Credit/Debit Card Guarantee
    With any Credit card details you have supplied, it can only be used for the following reasons:
    1. To pay the Deposit
    2. To settle an outstanding Balance 
    3. To settle cancellation fees 
    4. To settle amendment/option fees 
    5. To settle bills 
    6. To settle damages to property 
  30. Law & Jurisdiction
    In the event of a dispute concerning the terms of this contract, the court of law of London will have jurisdiction. .
